Yes, this does come with a pocket clip. it can be moved to all four tips of the knife for tip-up, tip-down, blade out, blade in configuration.

Is it a tip up or tip down?

Either or. You can switch it to suit you, right or left handed, tip up or down!

I bought one last week and on the first use the edge cracked. I hope thus was just a flaw in the metal. How about a replacement?

You will have to contact the Ontario knife company or look on their website for return info. Then You will probably have to ship it to them and if they deem it their fault they will probably replace the blade. But check the website first.
