6-8, my daughter is 40 lbs but a little shorter and I feel the tights fit well, but they are too long. On your daughter there should be enough fabric that even if they are a tad big on the waist, the extra fabric should keep them up. They are stretchy so they should be good. I wouldn't get the 3-5 bc she will probably be too tall for them.
